1 TERMS AND CONDITIONS
1.1INTRODUCTION
These Terms and Conditions (which may be altered at any time) govern the use of this website and the agreement between both parties (the “Terms”). These Terms enshrine the rights and obligations of all users (“You” or “The Client”), on the one hand, and those of Casas Do Paço, (“Casas Do Paço”), on the other, regarding the goods and services made available on this website, hereinafter jointly referred to as “services”. Before paying for the reservation operation, you should read these Terms carefully. If you do not agree to these Terms, in its entirety, you should refrain from making any reservations. In case of doubt about these Terms, please contact us using our e-mail address mentioned on the website. Casas Do Paço, https://casadopaco.pt, is registered under the NIPC no. 514 762 055, with address at Rua da Restauração, 148-A, 4710-428 – Braga, Portugal.
1.2 USE OF THIS WEBSITE
These Terms are the only conditions applicable to the use of this website and prevail over any other conditions, except in case of express agreement of Casas Do Paço, previously given in writing. When making a reservation, the User confirms that he has read these Terms, which he accepts without any reservation. You agree that: You may only use this website to make legitimate inquiries or reservations. You will not make reservations of a speculative, false or fraudulent nature. If Casas Do Paço has reasonable grounds to believe that a particular reservation is of such a nature, it reserves the right to cancel it and to inform the competent authorities. The User must communicate to Casas Do Paço an email address or postal address, or the data related to another form of contact, that is correct and complete and accepts that Casas Do Paço can contact you using such data if you deem it necessary (see privacy policy). If you do not provide Casas Do Paço with all the information it deems necessary, it may not be possible to complete your reservation. By making a reservation through this website, the User declares that he / she is at least 18 years of age and has the legal capacity to contract.
1.3 LEGAL FRAMEWORK
On this website, the leasing of the real estate is solely and exclusively for non-permanent housing, for short periods of a transitional nature, in accordance with article 3 of Decree-Law no. 39/2008 of 7 March (article which stipulates the aspect of Establishment of Local Accommodation). Casas Do Paço is registered in CAE 55201, in the legal figure of Local Accommodation, according to Decree-Law no. 39/2008, and has registered the legal real estate that it exploits for this purpose with the competent City Council.
1.4 AVAILABILITY OF SERVICE
Reservations are made by Casas Do Paço, and the availability of products and services is duly indicated. However, the reservation is only effective after sending your confirmation.
1.5 FORMATION OF THE CONTRACT
The information contained in these Terms is not a proposal for sale but a mere invitation to negotiate. No agreement will be established between Casas Do Paço and the User without the reservation being accepted by the first. The contract of provision of accommodation services between the User and Casas Do Paço (Contract) will only be formalized with the communication of the Reservation Confirmation. Upon the Client’s entry into the booked property, both parties will sign a local accommodation contract, which will regulate the terms of their use. The Reservation Confirmation is issued after a good charge of the reservation amount. This Confirmation identifies the User, the number of companions, the date of check in, the duration of the stay, the amount already paid in the reservation, the amount payable at check in, the payment modalities of the remaining value, the address of the apartment and the respective directions to reach the place.
1.6 AVAILABILITY OF PRODUCTS
Any booking process is subject to availability until the confirmation of reservation by Casas Do Paço. The simultaneous interest for the same product by different Users follows the chronological order in which Casas Do Paço receives the reservation payments. In the event of unavailability, Casas Do Paço reserves the right to inform the User about the existence of alternatives of equal or greater quality and value, which the latter may confirm.
1.7 REFUSAL OF RESERVATION
Casas Do Paço reserves the right at any time to withdraw any offer contained in its reservation page. Casas Do Paço will not be responsible to the User or any third party for the withdrawal of any offer that appears on this website. All reservations previously confirmed by Casas Do Paço for the offer in question are assured.
1.8 RIGHT OF FREE USER RESOLUTION
The user may cancel or change the terms of his reservation, however the cancellation by the User will incur costs in accordance with the Cancellation Policy.
1.9 BOOKING
The User, in order to obtain the eligibility for the Contract, will have to make a reservation corresponding to 50% of the total budget for the stay.
1.10 PRICE
Except in case of obvious error, the price of the services will be what is indicated at each moment in the website. If Casas Do Paço finds that the price indicated for the stay or reservation is incorrect, it will inform the User as soon as possible, giving you the choice between reconfirming the reservation at the correct price or canceling it. If it is not possible to contact the user, the reservation will be canceled and the user will be fully refunded if he has already paid the reservation price. Prices are subject to change at any time but, except as noted above, this change will not affect reservations for which a Confirmation has already been issued. Prices quoted include accommodation, use of all property in housing, water, gas, electricity, internet and television expenses (basic package).
1.11 VALUE ADDED TAX
In accordance with the rules and regulations in force, the prices of the services indicated on this Website also include Value Added Tax (VAT) at the legal rate in force.
1.12 PAYMENT
The provision of temporary local accommodation services is regulated according to a policy of full payment of the stay, on the day that access to the property is granted (check-in), otherwise the Client has no eligibility to use the Property. Casas Do Paço accepts the following payment methods upon reservation (50%) of the total amount of the stay):

Casas Do Paço accepts the payment methods identified above (items 1 and 2), provided that they are made at least 14 working days before the day of check-in. This advance allows the reception of the money in good time, before the arrival of the Client to the apartment. The necessary information for the bank transfers will be provided by Casas Do Paço, in the process of requesting a stay by the Client.
1.13 PRIVACY AND SECURITY
The data of the Client, the bank transfer and written communications are confidential, and will not be provided to third parties, except for the banking entity that will process the payment. Personal data will be used exclusively for the purposes of the services requested by the Client .
1.14 CANCELLATION CONDITIONS
The cancellation of a reservation by the User (including for reasons of force majeure) implies payment of compensation to Casas Do Paço for the opportunity cost involved. Likewise, reducing the number of nights or reducing the number of guests during the stay also implies a loss of revenue for Casas Do Paço, so this implies the payment of an amount in proportion to the loss of revenue. The costs for the User are: • Cancellation more than 14 days before arrival – 100% refund of the reservation amount; • Cancellation less than 14 days – you must pay the entire stay. The refund of any amount paid will always be made by bank transfer, and the costs of this international transfer will be borne by the User. Any changes or cancellations must be made by written communication (they will not be accepted via telephone). The change of dates of the stay will be analyzed individually by Casas Do Paço and the User may incur costs if this change constitutes damage to Casas Do Paço. Casas Do Paço advises Users to take out travel insurance for eventual cancellation due to force majeure.
1.15 RESPONSIBILITY AND EXCLUSIONS
Casas Do Paço’s liability for any reservation through this website is limited exclusively to its purchase price. Casas Do Paço is not responsible for any damages that directly or indirectly result from the inappropriate use of the apartment, including damages, theft, insecurity, unlawful behavior, improper use of equipment, particularly by the elderly, the disabled or by children , resulting from failure of the duty to monitor them. The same applies to any deficiencies in the provision of gas, electricity, water, internet, television and services provided at the condominium level.
1.16 INTELLECTUAL PROPERTY
The User acknowledges and accepts that all copyrights or trademarks and other intellectual property rights relating to any and all material and content that forms part of this website remain at all times in the ownership of Casas Do Paço or the its licensors. The User is allowed to use said material only to the extent expressly authorized by Casas Do Paço or its licensors. This does not prevent you from using this website to obtain budget proposals, a copy of a reservation or the terms of the Agreement.
1.17 WRITTEN COMMUNICATIONS
The applicable law requires that some of the information or communications that Casas Do Paço sends to Users takes the written form. By making use of this website, the User accepts that the communication between him and Casas Do Paço contemplates above all the electronic form. Casas Do Paço will contact the User by email or provide information by inserting notices on this website. For contractual purposes, the User accepts this means of communication electronically and acknowledges that any contracts, notices, information and other communications that Casas Do Paço transmits electronically satisfy the legal requirement that such communications be made in writing.
1.18 COMMUNICATIONS
All communications from the User to Casas Do Paço must be sent through the electronic form or electronic addresses mentioned on the site. Casas Do Paço can communicate with the user either by email or other electronic support, (SMS) to the address included in the reservation. Casas Do Paço undertakes to respond to the client within a maximum of 72 hours after receiving a communication. The User undertakes to communicate any changes to his / her contacts.
1.19 TRANSMISSION OF RIGHTS AND OBLIGATIONS
The User may not transmit, assign or encumber his contractual position, or otherwise dispose of the Contract or any rights or obligations arising therefrom, without the prior written consent of Casas Do Paço.
1.20 EVENTS OUTSIDE THE CONTROL OF Casas Do Paço
Casas Do Paço shall not be liable for non-performance, or delay in performance, of any obligation arising out of the Contract that is due to an event beyond its reasonable control, (“Force Majeure Event”). A Force Majeure Event comprises any event, act or omission, beyond the reasonable control of Casas Do Paço and includes, in particular (but not exclusively), the following: a) Strikes, lock-outs and other labor actions; (b) civil strife, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threatened with war preparations; c) Fire, explosion, storm, flood, earthquake, sinking, epidemic or other natural disaster; d) Impossibility of the use of public or private telecommunications networks; Casas Do Paço’s obligation to comply with any Contract shall be suspended for the duration of an Event of Force Majeure and shall give rise to an extension of its term equivalent to that duration. Casas Do Paço will make reasonable efforts to terminate a Force Majeure Event, or to find a solution to meet its contractual obligations despite the existence of a Force Majeure Event.
1.21 WAIVER
If Casas do Paço, at any time during the term of the Agreement, refrain from demanding compliance with any obligation that the User derives from the Agreement or these Terms, or exercise any right or faculty provided for therein, this shall not constitute a waiver of these rights and powers and will not exempt the User from the fulfillment of its obligations. Casas Do Paço’s waiver of the exercise of any right or faculty, in relation to a particular situation of non-compliance by the User does not mean waiving rights or faculties in the event of a subsequent default. Casas Do Paço’s waiver of any right resulting from the Agreement or these Terms will only be effective if it appears in written communication sent to the User in the manner provided in the Communications clause, where the latter expressly declares the waiver.
1.22 REDUCTION
The declaration of invalidity, illegality or ineffectiveness by any competent authority of any provision of these Terms and Conditions shall not affect any of the remaining provisions, which shall continue in full force and effect.
1.23 COMPREHENSIVE AGREEMENT
The attached documents form an integral part of these Terms and Conditions: a) “Procedures” (Exhibit 1), which defines all the procedures to be carried out at the time of check-in, stay and check-out; b) Contract for Provision of Temporary Local Accommodation Services (Exhibit 2), which defines the contractual terms of use by the Client, the rights and responsibilities of the intervening parties. The applicability of this document resides during the Customer’s stay. These Terms and any documents referred to therein constitute the entire agreement between the parties relating to the formation of a Contract.
1.24 AMENDMENT OF TERMS AND CONDITIONS BY Casas Do Paço
Casas Do Paço has the right to change these Terms and Conditions at any time. The User is subject to the principles and terms in force on the date of their reservation, unless the law or competent authority imposes any changes thereto, or the Privacy Policy, (such changes being applicable to reservations already made).
1.25 APPLICABLE LAW AND FORUM
Casas Do Paço and the User undertake to reciprocally fulfill all the obligations assumed in these Terms, and in all other matters the Portuguese Law in force will apply. For the resolution of disputes arising from these Terms, the jurisdiction of the Braga district is stipulated.
2 DOCUMENT ANNEX1 – PROCEDURES
2.1 CHECK IN AND CHECK OUT
Check in time can be from 12 a.m. to 8 p.m. for the situation where the apartment is vacant on the respective day. If the apartment is busy this morning, check in will be after 3pm. Check out must be done until 12 noon. Check in from Monday to Friday, from 3:00 p.m. to 8:00 p.m., there are no extra charges, excluding holidays in Portugal. Supplements for check in in particular situations: 25 € between 21:00 and 00:00 from Monday to Sunday; 40 € between 00:00 and 02:00 from Monday to Sunday; The identification of Casas Do Paço employee who will check in will be informed via e-mail to the Client. The Client must call the limit up to 1 hour before arrival in the apartment and in case of delay.
2.2 PERSONAL DOCUMENTS, PAYMENTS AND PROCEDURES IN THE CHECK IN ACT
You must present your citizen’s card or passport. At the check-in, Casas do Paço’s collaborator will have the following functions: • Explain the operation of household appliances and housing features; • To request the signature of the reservation form or the Temporary local accommodation service agreement and its annexes in case of stays longer than 15 days; • Obtain identification data from the responsible Customer; • Present the informative dossier of equipment and accessories; • Give the property key; • Indicate to the Client who Casas do Paço’s employees can be contacted in case of need during the stay; • Receiving missing receivables or additional services, (in cash or MB), unless the Customer has already paid it by bank transfer or credit card; • Receive from the Client the amount intended for collateral for reckless use of the property and its assets, in case of long stay; • Give the Client the discharge document regarding the amounts paid; Note: the maximum withdrawal limit in an ATM in Portugal is 400.00 euros / day.
2.3 PROCEDURES IN THE CHECK OUT ACT
At the checkout, the Customer must be present. In case of impossibility, you must inform Casas Do Paço that you will analyze the situation and possible solutions. In the act of checking out, the collaborator of Casas Do Paço will have the following functions: • Receive the housing key; • Check the state of housing and property, as well as the cleanliness of the premises; • To return the value of the security if it is verified to the situation of a prudent use of the goods and a normal cleaning of the house; • Signature by the Client of the document of return of the security amount, if it exists;
2.4 AMOUNT OF DEPOSIT / DEPOSIT
The objective of the deposit (Deposit of amount) serves as security to cover any damages that may occur during the stay and that are the responsibility of the User. The value of the security deposit may be variable and is only applicable for stays longer than 3 weeks. Payment of the deposit can be made by bank transfer or cash. At the time of check out, Casas do Paço staff will check the condition of the apartment, accessories and appliances and, in case of normality, will return the deposit paid.
2.5 IDENTIFICATION OF GUESTS
At Casas Do Paço, reserves the right to ask the Customer for the identification of the guests who accompany him during the stay.
2.6 BEHAVIOR AND RESPONSIBILITIES
The User signing the Local Accommodation Contract shall be responsible for the behavior of all persons accompanying him or her and shall avoid any illegal activity or public health. You should also take due care and respect with the equipment present in the apartment and avoid damaging them, informing Casas Do Paço of any alteration of the order or breakage / breakdown of material.
2.7 PROCEDURES DURING THE STAY
2.7.1 CLEANING
The apartment will be cleaned before the arrival of each User. On leaving, the User must leave the apartment in a reasonably clean condition and towels can not be used for cleaning objects. Otherwise, Casas Do Paço will have the right to charge additional costs of € 10 for each damaged towel. If the stay lasts longer than 1 week, the User may request from Casas Do Paço the cleaning services he deems necessary, paying the same amount as the service charge stipulated for that Place, for each one.
2.7.2 EQUIPMENT FAILURES, BREAKDOWN OF GOODS, QUESTIONS
In all these situations (and others) that affect the normal use of the contracted goods and services, the Client shall contact Casas Do Paço through any available means of communication, so that it begins to solve the identified problem. If it is necessary to move to the dwelling, this will be previously scheduled with the Client. Cancellation Policy:
The customer can cancel free of charge up to 14 days before the arrival.
The customer must pay the full amount if they cancel within less than 14 days of the date of arrival.
In case of no-show, the guest will have to pay the total amount.
For every check-in between 19:00 and 00:00 we charge 25€. Guests cannot check-in after 00:00. The cleaning fee has a maximum value of € 40 and a minimum of € 20, and may vary depending on the accommodation booked.
